How long should construction site photos be retained?
Against the limitation period, not the programme. Defects claims arrive years after handover, and in the UAE decennial liability for structural defects runs for ten years. The photographs either still exist then, or they do not.
The mismatch nobody plans for
A project team disbands at handover. The site email goes away, the shared drive gets archived, and someone in IT eventually reclaims the storage. All of this is reasonable, and all of it is planned around the PROJECT’s life.
But the claim is not on the project’s timeline. It is on the limitation period’s timeline — and those are different by years. A defects claim can land long after the last person who remembers the pour has left the company.
What the periods actually are
They vary by jurisdiction and by contract, and you should get the number from your own counsel rather than from a web page. But the order of magnitude is worth internalising: in the UAE, decennial liability for structural defects runs for ten years from completion. Defects-liability periods under the contract are much shorter, and it is a mistake to plan retention around them.
Retain to the longest applicable period. Storage is cheap. An opening-up exercise, to prove something you photographed and then deleted, is not.
Decide it once, deliberately
This is the whole practical point. Retention either gets decided once, on purpose, by someone thinking about a dispute that has not happened — or it gets decided by an IT clear-down that nobody was consulted about, in a year nobody remembers.
And you will not find out which happened until the day you need the photograph.
