Who is liable for a subcontractor’s safety violation?
Potentially both of you. Under multi-employer citation policies, the controlling contractor can be cited for a subcontractor’s violation — and in the GCC, prequalification regimes gate future work on HSE performance regardless of whose crew was at fault. You can back-charge the cost of correction under the contract. You cannot contractually transfer reputational or criminal exposure.
The part you can transfer, and the part you cannot
Contracts are good at moving money. Flow down the HSE requirements, and back-charge the cost of correcting a subcontractor’s failures — that mechanism works, and it should be in the contract.
What no contract clause moves is the rest of it: the citation naming you as the controlling employer, the investigation, the coverage, the client who now has a view about your safety culture, and — where the consequences are severe enough — criminal exposure. Those attach to control, not to whose logo was on the hard hat.
Which is why auditing your subs is self-defence
Auditing a subcontractor is not a courtesy extended to them; it is a control exercised on your own behalf. Prequalify on safety history rather than on references. Audit against performance triggers rather than a rota, so a deteriorating subcontractor gets attention before an incident supplies it.
And keep the trend, not just the score. A subcontractor whose audit score is rising while its violation count rises alongside it is telling you something specific, and it is not that they are getting safer.
