What is the difference between a willful, repeat and serious safety violation?
A serious violation means a hazard existed that could cause death or serious harm, and the employer knew or should have known. A willful violation means the employer knew and did it anyway — intentional disregard or plain indifference. A repeat violation means the same or a substantially similar violation was cited before. Willful and repeat both carry a maximum penalty ten times that of a serious violation, because both prove knowledge.
Knowledge is the axis they all turn on
Read the three categories in order and the same variable moves through all of them: what did the employer know, and when?
A serious violation asks whether you knew or reasonably should have. A willful violation says you knew and proceeded regardless. A repeat violation removes the argument entirely — you were told, in writing, by an inspector, and here it is again. That is why the law reserves its heaviest response not for the most dangerous hazard, but for the hazard you had already been informed about.
The ten-to-one ratio, and why it is the durable fact
The maximum penalty for a willful or repeat violation is set at ten times the maximum for a serious one. The dollar amounts behind that ratio are adjusted for inflation every year; the ratio itself is statutory and does not move.
Which means the ratio is the thing worth understanding. It encodes a judgment about culpability rather than about harm — and it is the reason repeat-offender tracking is not administrative hygiene but the most commercially consequential thing a violation log does.
